高等学校与学生之间行政关系的探讨

摘    要
      20世纪的最后几年，我国公立高校，在经历和实行国家有关教育管理、投资、招生、学校管理、教学科研、毕业就业等多方面改革措施之同时，面临着主要由学生直接发起的法律挑战。诉讼实践的广泛展开，引起了广泛的关注，也使得我们不禁思考案件背后的问题，亦引发学界与司法界纷纷就相关问题进行理论上的探讨。本文主要针对高校与学生之间的行政关系进行了探讨。高校与学生之间的法律关系到底如何，两者在行政法律关系中的定位又是怎样，如何解决我国高校与学生之间的法律纠纷及二者关系中的矛盾等等，都是本文的主要内容。笔者希望能通过理清高校与学生之间的法律关系，提出解决主要矛盾的方案，从而有助于学生更好的学习和学校的顺利教育，进而为国家立法和学校定制提供参考。

Explore of the administrative relations between institution of higher learning and students
Abstract
     The last few years of the 20th century,China's public institutions of higher learning, experience and practice in the state of education management, investment, students, school management, teaching and research, graduate employment aspects of the reform measures, at the same time, facing directly initiated mainly by students of the legal challenge. Launched extensive litigation practice has aroused widespread concern, but also makes the case we can not help thinking behind the question, academia and the judiciary have caused on the related issues of theory. This article mainly for college students and the relationship between the executive was discussed. College students and the legal relationship between how in the end, the legal relationship between the two on the position and how, how to solve China's colleges and universities and among students of legal disputes and contradictions in the relations between the two, are the main paper content. I hope that through college and sort out the legal relationship between students, to propose solutions to major contradictions of the programme, which helps students better learn the smooth progress of education and schools, then schools for national legislation and provide customized information.
