摘   要
     随着世界器官移植技术的发展，相关法律问题的出现不可避免。为了更好的发展器官移植技术，更加广泛、优质的服务于广大患者，必然要有一套行之有效的方法来解决由器官移植涉及到的法律问题。本文结合器官移植的历史发展状况以及在此基础上产生的法律问题进行探究，通过对国内外立法的发展趋势做相应的比较，从而针对如何解决器官移植中的法律问题提出自己的建议与意见。
关键词：器官移植，知情同意，脑死亡，自愿捐献，推定同意

On organ transplants in the legal issues and solutions
Abstract
With the development of organ transplant technology,legal issues related to the emergence of inevitable . In order to better the development of organ transplant technology, more extensive, high-quality services in the vast number of patients, must have a proven approach to the problems of organ transplantation from the legal issues. In this paper, with the historical development of organ transplants in this situation and on the basis of the legal issues of Inquiry, through domestic and international legislation on the development trend of the corresponding comparison, to address how to solve the organ transplant in the legal issues put forward my own suggestions and comments.
