摘    要

      2007年3月16日第十届全国人民代表大会第五次会议通过了《中华人民共和国物权法》，以下简称为《物权法》。《物权法》第20条规定：“当事人签订买卖房屋或者其他不动产物权的协议，为保障将来实现物权，按照约定可以向登记机构申请预告登记”。从第20条的规定来看，物权法中预告登记适用于房屋及其他不动产的债权请求权，物权变动的债权请求权只涉及不动产物权的转移。从立法技术上来看，第20条采用了例举式和概括式并举的方式。这种方式突出了房屋买卖在预告登记制度中的重心位置，凸显了对解决我国现在面临的一屋二卖甚至数卖问题的重视，但同时因其仅概括式地将其他不动产物权规定于适用范围内，使其在解决买卖房屋以外的一些现实问题上不能起到实质上的作用，比如建筑工程承揽人的优先受偿权，租赁权等。本文试就《物权法》中预告登记适用的范围进行分析和建议。

On China's economic compensation system for divorce
Abstrat
March 16, 2007 of the Tenth National People’s Congress passed the fifth meeting of the “People’s Republic of China Property Law”, hereinafter referred to as “property Law”. “Property Law” Article 20 provides: “The parties signed a sale and purchase housing or other real estate property rights agtreement, to safeguard the future realization of property rights, in accordance with the agreement can register to apply for registration notice”. From the provisions of section 20, notice of registration of property law applicable to housing and other real estate claims the right to requset, and Property Claims of change involves only the right to request the transfer of immovable property rights. Article 20 of the examples used for both general-and the way highlighted in the notice of the sale of housing registration system in the center position, highlighted the attentiont that how to solve the problem that a housing estate sale is sold several times. But at the same time only because of their broad-real estate and other property rights provisions within the scope of application to the sale of housing in solving practical problems outside of some can not play a substantial role, for example, the problem that how to achieve the Priority of Compensation of Our Country Architectural Engineering Contractor Project Cost and Rents the power. Overall, the “property rights” in the notice of the registration application is narrow, it is should be appropriate to expand. This paper try to analysis of the registration application of the scope of the notice and make recommendations.
