摘    要
      婚姻问题与我们每个人都息息相关，它的处理关系到个人的幸福和社会的稳定。因此立法者对因婚姻关系而产生的精神损害赔偿问题加以重视。《中华人民共和国婚姻法》已确立了我国离婚精神损害赔偿制度。虽然我国婚姻立法及相关司法解释对婚姻关系中的财产处理问题规定得较为全面，对精神损害赔偿问题虽有涉及，但与西方发达国家相比还有许多需要完善的地方，现有法律规定不具体、赔偿范围狭窄等立法缺陷，使离婚精神损害赔偿制度存在不足，婚姻家庭法律制度是关系到每一个社会成员切身利益的极其重要的制度体系，司法工作者和人大代表提议把离婚家庭所带来的负面影响和对当事人的权益纳入赔偿范围之列。

The marriage problem is all vitally related with our everybody, it of the processing relate to personal happy and social stability. So the lawgiver value the spirit indemnity problem which produces because of marital relationship.have already established an our country a divorce spirit indemnity system. Although our country marriage lawmaking and related and judicial explanation to property within marital relationship processing problem rule more overall, to spirit indemnity although the problem has been already involve, flourishing with west nation compare to still have many need a perfect place, the existing law doesn't concretely rule, indemnification scope narrow etc. lawmaking blemish, make the divorce system existence of the spirit indemnity shortage, the law system of the marriage family is relate to each social member to slice a body benefits of very and important system, judicial worker and person greatly represent proposal to make the divorce being negative the influence what family bring and bring into row of compensate the scope to the rights of the party concerned.
